Terms of Engagement

This document sets out the general terms under which Castlefield Recruitment Ltd (“the Employment Business”) will provide work-finding services to you, “the Work-Seeker”.

1. Our Relationship

The Employment Business will try to find temporary or contract work for the Work-Seeker.

The Work-Seeker is engaged on a temporary or contract basis and is not an employee of the Employment Business. The Work-Seeker will be employed under a contract of service or a contract for services.

2. Pay

The rate of pay and basis of payment (hourly, daily) will be confirmed in writing before the Work-Seeker begins an assignment.

Pay will be made weekly in arrears.

Pay will be subject to statutory deductions such as tax and National Insurance and may be subject to additional deductions depending on the payment method or employment status, such as Umbrella Company Margin fees. No other deductions will be made unless stated in writing.

If additional services are offered by the Employment Business the Work-Seeker has a right to withdraw from the service prior to any related costs being incurred by the Employment Business. No refunds or rebates are payable on additional services offered.

The Employment Business will not charge the Work-Seeker any fees for work-finding services.

The Work-Seeker will receive not less than the prevailing National Minimum Wage.

The Work-Seeker will be paid for all hours worked, regardless of whether the Employment Business receives payment from the hirer.

3. Holiday Entitlement

The Work-Seeker is entitled to a minimum of 5.6 weeks of paid holiday including bank holidays in line with the Working Time Regulations.

The way holiday pay is calculated may vary depending on the assignment.

Full details will be included in the Assignment Details/Schedule provided before the start of each role.

4. Notice Periods

A notice period of no less than one week is required for either party to terminate this agreement. Individual assignments may have different notice requirements, which will be detailed in the Assignment Details/Schedule for that assignment.

5. Assignment Details

Before starting any assignment, the Employment Business will provide the Work-Seeker with a written Assignment Details/Schedule document.

The details provided in the Assignment Details/Schedule document regarding pay, holiday entitlement, and notice periods will take precedence over the general terms outlined in these Terms of Engagement.

This document will include:

• Client name and location

• Job title and duties

• Pay rate and method of payment

• Holiday entitlement for that assignment

• Notice period

• Hours of work

• Expected start and end date

6. Candidate Responsibilities

The Work-Seeker agrees to:

• Provide accurate information about their qualifications and right to work.

• Carry out assignments to the best of their ability.

• Notify the Employment Business promptly of any changes to their circumstances.

7. Governing Law

This agreement is governed by the laws of England and Wales.

This Agreement shall be deemed accepted upon your request for (or engagement of) our services.
